Lesson 5: W-8EXP Overview

In this lesson, ComplyPro covers the Form W-8EXP. This form is used by non-U.S. persons to certify their non-U.S. status and claim exempt status as specific entities, such as foreign governments, international organizations, or foreign tax-exempt organizations. To establish eligibility for exemption from 30% withholding under certain sections, necessary documentation must be provided, such as determination letters or opinions of U.S. counsel. The W-8EXP is generally valid indefinitely, but in some cases, it has a three-year validity period. A U.S. TIN is usually required for certain exemptions. The form requires a signature, and certifications should not be altered.
